Q & A: Upgrades from Regular to Premium Processing

Question: At this time if we upgrade it to premium processing, what will happen? I heard that the case will be taken away by different officer and start to review over again as initial review, is that true? Does it have negative effect if we upgrade to premium processing once we receive RFE?

Answer: Correct, the case will be moved off the desk of the current officer and reviewed by a different officer, in the premium processing unit. Since the new officer is seeing the case for the first time, they will presumably look at the initial submission, in addition to the RFE response. This means that if a weakness in the case was overlooked by the first officer, a premium processing officer might identify it and issue another RFE.

Whether or not to upgrade is a strategic decision based on case specific circumstances. We have responded to RFEs and sought upgrades to premium processing successfully on a number of occasions. We employ this strategy in situations where we feel putting the case in front of a presumably better trained officer will work to our advantage, or we are facing a timing issue. In our experience, as long as the case is sound, ie, approvable - the upgrade strategy has been very effective.
