New ICE policy to govern removal proceedings involving aliens who are legally eligible to apply for green cards

On August 20, ICE (Immigration and Customs Enforcement) issued a memorandum to the agency about how to handle deportation cases involving foreign nationals who are also legally eligible to apply for green cards.

While the memo has led to concern/talk of "back-door amnesty", it affects only foreign nationals in deportation proceedings who are the beneficiaries of immigrant visa petitions, which, when processed, will give them an immediate right to file for a green card. In other words, the memo affects only people who can immigrate legally under existing laws.
